These Terms of Service ("Terms") are an agreement between you and FableFile LLC., an Arizona limited liability company ("FableFile," "we," "us," or "our"). They govern your use of fablefile.com (the "Site") and your purchase of digital products from the Site ("Products"). These Terms apply to fablefile.com only. They do not apply to our Etsy shop, Amazon KDP books, or other marketplaces, which are governed by those platforms' terms.
1. Acceptance
By using the Site or buying a Product, you agree to these Terms, our Privacy Policy, our Refund Policy, and our License. If you don't agree, please don't use the Site.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to buy from the Site. If you are younger, you may use the Site only with the involvement and consent of a parent or legal guardian, who agrees to these Terms for you. Sales on the Site are currently limited to customers with U.S. billing addresses, and we may change the countries we sell to.
3. No customer accounts
The Site does not offer customer accounts or logins. You check out as a guest through Stripe Checkout, and your order is linked to the email address you provide. Please give an accurate email address so we can deliver your files and receipt. Keep your order emails and order-page link private, because anyone with them can download your files.
4. Orders and pricing
- Prices are shown in U.S. dollars (USD). We may change prices, products, and promotions at any time. Price changes won't affect orders already placed.
- Sales tax is calculated by Stripe Tax and added at checkout where required by law.
- Payments are processed through Stripe Checkout. By paying, you also agree to Stripe's terms. FableFile never stores your full card number.
- Your order-confirmation email is your receipt for the purchase.
- We may refuse or cancel any order, for example because of a pricing error, suspected fraud, or misuse. If we cancel a paid order, we will refund you.
- We try to describe Products accurately. Colors and appearance may vary by screen, printer, and paper.
4A. Customer support and AI-assisted replies
We use artificial intelligence (AI) tools to help draft replies to customer messages. A person at FableFile reviews and approves replies before they are sent. Your message and related order details may be processed by our AI service providers as described in our Privacy Policy. Replies are for help with your order and the Products only.
4B. Free downloads and email sign-ups
Some free Products may be offered in exchange for joining our email list. By signing up, you agree to receive our marketing emails. You can unsubscribe at any time using the link in any email. Free Products are covered by our License, the same as paid Products.
5. Digital delivery
All Products are digital downloads. Nothing is shipped. After payment, we email your download links. Each link works up to 5 times within 72 hours, and for 30 days after purchase you can use the order page linked in your confirmation email to get fresh links. Please download and save your files promptly. You are responsible for having compatible software and devices (for example, Canva, Procreate, Adobe Photoshop, a PDF reader, GoodNotes, or Cricut/Silhouette software). Refunds are handled under our Refund Policy.
6. License to use Products
When you buy a Product, you receive a license to use it. You do not buy ownership of the design. Your rights and limits are explained in our License and in any specific terms on the product listing. In particular, you may not resell, share, or redistribute our files, or use them to train AI models.
7. Intellectual property
The Site and all Products, designs, graphics, text, photos, and other content are owned by FableFile or its licensors and are protected by copyright, trademark, and other laws. "FableFile" and our logo are our trademarks. You may not copy, modify, distribute, or use our content except as allowed by these Terms and the License.
8. AI-created content
Some of our designs are created with the help of artificial intelligence (AI) tools and then selected, edited, and refined by FableFile. Because of how AI tools work, these designs may not be unique. Similar images may exist elsewhere, and FableFile makes no claim of exclusivity for AI-assisted designs. Copyright protection for AI-generated material may be limited. Where we know a product is AI-assisted, we aim to say so on the product listing.
9. User conduct
When using the Site, you agree not to: - break any law or infringe anyone's rights; - share, resell, or publicly post our files, or bypass download limits; - scrape, copy, or bulk-download Site content, including for AI/ML training; - interfere with the Site's security or operation, or upload malware; - make fraudulent purchases or misuse payment disputes; or - impersonate anyone or give false information.
If you send us reviews, comments, or ideas, you give us permission to use them, without payment to you, to run and promote our business.
10. Copyright complaints
We respect intellectual property rights. If you believe content on the Site infringes your copyright, email tj@fablefile.com with: 1. your name and contact information; 2. a description of the copyrighted work; 3. the location (URL) of the material you believe infringes; 4. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law; 5. a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and 6. your physical or electronic signature.
We will review valid notices and remove material where appropriate.
11. Third-party trademarks
FableFile is an independent business. We are not affiliated with, endorsed by, or sponsored by Canva, Procreate (Savage Interactive), Adobe Photoshop, GoodNotes, Cricut, Silhouette, or any other company whose software or devices our Products work with. These names are trademarks of their owners and are used only to describe compatibility. Your use of third-party software is subject to its own terms, including Canva's license terms for any Canva elements in our templates.
12. Third-party links and services
The Site may link to third-party websites or services (such as Stripe, Cloudflare, Resend, Instagram, Pinterest, and Facebook). We are not responsible for their content, policies, or practices.
13. Disclaimers
THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Site will be uninterrupted or error-free, or that Products will meet every need or work with every device, software version, printer, or cutting machine. Planners and printables are organizational tools only and are not professional (for example, medical, financial, or legal) advice.
14. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, FABLEFILE AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR MATERIALS (SUCH AS PAPER, INK, OR VINYL), ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM. Some places do not allow certain limits, so some of these may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless FableFile and its owner from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or the License, your misuse of the Products, or your violation of anyone else's rights.
16. Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Pima County, Arizona, and you consent to their jurisdiction. This does not take away any mandatory consumer rights you have under the laws of the place where you live.
17. Changes to these Terms
We may update these Terms from time to time. We'll post the new version on this page and update the "Effective date." Changes apply to future use and purchases. Continuing to use the Site after changes are posted means you accept them.
18. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision right away, we have not waived it. These Terms, together with the policies and License linked above, are the entire agreement between you and FableFile about the Site.
